Constitutions do fail!
Often letters
remains but spirit fails. Constitutions do not fail in the parliaments but they fail in
the minds of its people.
But why do constitutions fail?
Constitutions are fragile masters who
often needs protections from their own agents, the very government it legitimizes!
Power is always hungry. It
tends to usurp more power. And the rulers often fall in trap. In order to wield
more power, they are ready to destroy the source of their own creation. They
want to become the source itself. The agent always wants to become the master himself.
Who can protect the constitution and
its ideas from brut power ?
Values of a constitution can only be
protected when they coincide with the values of the judges of that society.
Judges are the only guardians of the constitution. They are final interpreters
of ‘the Law.’
Often constitutions fail because ‘the
Guardians’ didn’t fight well.
